At this hearing – which must be requested within 10 days of your receiving notice of an action against your driving privilege – the Hearing Officer informs the driver of the legal grounds for the action. You also have the opportunity to review and challenge any DMV evidence and to present your own evidence, witnesses and testimony. Following the hearing, the Hearing Officer will make a decision to uphold, modify, or even set aside the DMV action.
