Fighting the Charges Against You…
If you come to Hutton & Wilson prepared to
fight, we want to make sure we’re prepared as well. We’ll
thoroughly investigate the charges against you in advance of an Admin
Per Se hearing before the Department of Motor Vehicles. At this hearing – which
must be requested within 10 days of your receiving notice of an action
against your driving privilege – the Hearing Officer informs
the driver of the legal grounds for the action. You also have the
opportunity to review and challenge any DMV evidence and to present
your own evidence, witnesses and testimony. Following the hearing,
the Hearing Officer will make a decision to uphold, modify, or even
set aside the DMV action.
In many instances, Hutton & Wilson attorneys
are able to have DUI charges reduced at this hearing – thus
avoiding a trial completely. But if we are not able to avoid a trial,
we move on to our ultimate goal – to successfully represent
our clients in winning the jury trial.
